Introduction to the Terms of Use Agreement

Article 1 – Introduction and Definitions

The above preamble is an integral part of this agreement. The following are the meanings and definitions of the key terms used herein:

  1. Store: Includes all forms of the store on the internet, whether an electronic application, a website, or a physical store.

  2. Consumer: The person engaging in e-commerce to obtain products or services provided by the store through its electronic platform.

  3. Agreement: Refers to these terms and conditions governing and regulating the relationship between the parties to this agreement.

Article 2 – Consumer’s Legal Capacity

  1. The consumer acknowledges having the legal capacity under Sharia and law to deal with the store or being at least 18 years old.

  2. The consumer agrees that, in the event of a violation of this article, they shall bear all consequences before third parties.

Article 3 – Nature of Commitment

  1. The store’s obligation towards consumers is to provide the agreed-upon service or product.

  2. The store may also provide other services, such as after-sales services, depending on the nature and type of service or product requested.

Article 4 – Usage Regulations

  1. The consumer agrees to use the store’s platform in accordance with public morals and applicable laws in the Kingdom of Saudi Arabia.

  2. When purchasing a service or product, the consumer agrees not to use it in any way that violates public morals or applicable laws in Saudi Arabia.

Article 5 – Accounts and Registration Obligations

When applying for membership in the store, you agree to:

  1. Be responsible for maintaining the confidentiality of your account and password, and immediately notify the store of any unauthorized use or security breach.

  2. Acknowledge that the store is not liable for any direct or indirect loss resulting from the disclosure of your account information.

  3. Use your account personally and accept full responsibility for it. If someone else uses it, it will be deemed that you have authorized them.

  4. Use the store with seriousness and honesty.

  5. Provide truthful, accurate, updated, and complete information when registering, and update it as needed.

  6. The store will handle your personal information and contact details with strict confidentiality.

  7. If you provide false, outdated, incomplete, or illegal information, the store reserves the right to suspend or terminate your membership without prejudice to other rights.

  8. Failure to comply with the above gives the store the right to suspend, cancel, or block your access.

Article 6 – Electronic Communication and Official Contact Methods

  1. The parties agree that communication will be via the email registered on the platform.

  2. All agreements, notices, and communications provided electronically are equivalent to written documents and are legally binding.

  3. The store may contact you regarding this agreement or your dealings by sending general or targeted messages through the platform.

Article 7 – Amendments to the Agreement and Fees

  1. If any provision of this agreement is annulled or deemed invalid, the remaining provisions remain in effect until further notice.

  2. This agreement may be amended from time to time and forms the basis of understanding between the consumer and the store.

  3. The store may impose fees depending on offers, products, services, or applicable government taxes.

  4. The store reserves the right to add, increase, reduce, or waive any fees in accordance with this agreement.

Article 8 – Payment Services

  1. The store provides payment options through its partners, either online or by other methods as announced from time to time.

  2. The store is committed to setting product or service prices according to market value.

  3. The store must provide invoices and receipts for all payments and ensure the consumer receives proof of purchase.

  4. The store must adhere to recognized accounting standards in line with this agreement and applicable laws.

Article 9 – Intellectual Property

  1. All intellectual property rights of the store are fully owned by it, whether established before or after the creation of the platform.

  2. The consumer must respect the store’s intellectual property rights, including its name, logos, symbols, and related trademarks.

Article 10 – Store Liability

  1. The store shall operate lawfully in compliance with Saudi laws and this agreement.

  2. The store is not liable for claims arising from errors, negligence, or actions by the consumer or third parties, such as shipping companies.

  3. The store guarantees that its products or services are lawful and authorized under Saudi regulations.

Article 11 – Account Restrictions

The store may suspend, cancel, or limit the consumer’s access to the platform at any time, without prior notice and for any reason.

Article 12 – Governing Law

This agreement is governed by and construed in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia and is subject entirely to the jurisdiction of its authorities.

Article 13 – General Provisions

  1. If any provision of this agreement becomes invalid, the remaining provisions remain in effect until further notice.

  2. Arabic is the official language for interpreting this agreement.

  3. Prices for products or services may be updated from time to time.

  4. Promotional offers are temporary, and the store may modify or cancel them at any time.

  5. The parties must deal in a manner consistent with Sharia, laws, and applicable regulations.

  6. This agreement may only be terminated by a decision from the store’s management.
